Labor and Employment
The labor laws on Sint Maarten are complex and often misunderstood by both employers and employees. We have considerable experience in drafting employment contracts and we have the ability to advise how to avoid lengthy and often costly litigation once a dispute arises.
We represent clients on labor and employment issues in litigation and administrative hearings. We have defended employers in courts and in administrative procedures against class action and single-plaintiff claims of discrimination, sexual harassment, breach of contract, workplace torts and the enforcement of trade secrets. We assist clients in determining the appropriateness of mediation, arbitration and other alternative methods to resolve employment disputes quickly and cost-effectively outside of the courtroom. We also represent clients in audits and investigations by the Social Insurance Bank and other federal and local government agencies.
In addition, we perform due diligence reviews in corporate transactions, advising clients on matters such as collective labor agreements and employment contracts. We draft and review personnel policies and procedures, individual employment agreements and collective labor agreements. We advise clients through potentially difficult employment situations such as hirings, terminations, workplace violence, disability, religious accommodations, investigating employee misconduct, downsizings and reorganizations. |
